The comments were made on her personal computer off-campus after school hours. The school decided to give her detention while going through her facebook and email, with another excuse being that she talked about sex with a boy. Represented by the American Civil Liberties Union of Minnesota (ACLUM), they went through a lawsuit, and the girl won 70k, along with an order that would stop school officials from attempts to regulate or discipline students based on speech made outside of school hours and off school property. ... ... It's awesome that the girl won the case, as the school had no right to go through her personal items, let alone the fact that she posted the negative comments after school at home. Sure, she said bad things against a teacher, but the school went too far. Freedom of speech comes in handy :3

Um,wow, that's invasion of privacy by the school. School computers they can watch all they want, but someone's home comp.? Um, no. Maybe the government can (and likely do), but not a school. After school hours is less relevant, as if it were after school hours on a school comp. they could still do something, the home computer invasion is more the issue.
Glad she won the case, the school had no right violating her own comp. Though I am curious, was her comp. on the school's network?

They are both in the fault. The girl shouldn't go into the teacher's personal life. Also unless you have a warrant you can't invade people's property.

While the student shouldn't have said anything negative, the school shouldn't invade her privacy like that and restrict her freedom of speech. To me, that's a more serious offense than some immature comment.

What, you telling me you never ever said anything along the lines of "Mr. Johnson is such an asshat, how am I supposed to do all this homework!"? Complaining about teachers has always happened, in various degrees of appropriateness, the only difference here is that it was on a social medium, and therefore recorded.

This is why I only complain verbally, or sometimes through Skype, when I'm not in school.

Yeppy, best to keep that kind of stuff to talking to irl friends or on messenging system like Skype, not post it where teacher can find it.
Still, I'm on the side of invasion of privacy being worse than negative comments, unless those negative were slanderous comments that could cause trouble for the person who they were said about, that'd be stuff like telling someone's private information, accusing them of a crime or harrassment which they didn't do, or making threats... the serious ones. Saying something like (teacher) was @sshole for giving some assignment you hated or giving too much homework isn't a serious misuse of freedom of speech.

The thing is that teachers are paid to teach students in the school. You are both forced to be there for students it is a law, and for teachers it is a source of income. It is like two people who work togethor. If some asshat at the power plant wrote on your facebook "You are an asshat do your job better" that is uncalled for. Don't barge into people's personal life. If it was a suspension I would actually be fine with that.

If it was a suspension I would actually be fine with that. I'm not really following your logic. She said this on her own Facebook page. Now if she went onto the teacher's FB page and said "Fuck u, 1v1 me fagot", then I'd be more inclined to agree with you. As it stands though, she was posting something on her own Facebook page. Schools and teachers should not be able to look at a student's FB page unless they're like a suicide risk.
